The individual submitting this form application (“Participant”) acknowledges and agrees that the features and functionality made available to Participant through the Smartsheet Early Adopter Program (“EAP Services”) are: (i) subject to change or discontinuance; (ii) provided “as is” without any warranty, support, maintenance, or other obligation of any kind; and (iii) not part of Smartsheet’s online services and applications, including the Subscription Service, as applicable, for purposes of Participant's agreement with Smartsheet governing their use of the Smartsheet collaborative work management service (the \"Agreement\"). If Smartsheet releases a generally available version of EAP Services, Participant will have the opportunity to acquire the generally available version under then current commercial terms. Any use of EAP Services is at Participant's sole risk and responsibility. Smartsheet may terminate Participant's access to and use of EAP Services at any time. Smartsheet may request that Participant provide feedback, suggestions, or opinions about the EAP Services, and such feedback, suggestions, or opinions will be treated in accordance with the Agreement. Participant further acknowledges and agrees that the EAP Services constitute Smartsheet Confidential Information under the Agreement and should be treated accordingly.
